The present research entitled: Society, Otherness and Law. The "socius" and the neighbor in Paul Ricoeur and in philosophical-legal perspective, has as its reference the thought of Paul Ricoeur, one of the greatest French philosophers and thinkers of the twentieth century, who has given us an impressive production destined to leave an indelible mark in contemporary philosophical literature; the high value of his work, original and varied, is the result of a philosophical path that from phenomenology and existentialism moves towards hermeneutics and psychoanalysis. Central pivot of the present work is the subject and its constitutive and inescapable relationship with the Other in its many forms; Other to be understood as stranger, as neighbor, as each, as self. Fundamental turns out to be the work Soi même comme un autre an expression of the Ricoeurian theoretical core as it condenses the deepest sense of Ricoeur's proposed conception of subjectivity: the valence, not comparative, but explanatory of the "as" self "insofar as" other constitutes a way of thinking identity and the subject, no longer in terms of a Cartesian and modern-style subjective self-position, but according to a phenomenological-hermeneutic perspective for which the other turns out to be implicated at an original and profound level in the process of constituting the self. In the light of these considerations, the hermeneutics of the self represents the only viable path for reflexive philosophy insofar as it elaborates a concept of identity derived from a long hermeneutic process traced in the world of signs of the other. The aim is to offer the reader, through the study of the main categories of otherness, a new perspective of the very vision of society understood as a Society of rights characterized by a logic - defined by the author - of reciprocity or sourabondance that goes beyond the utilitarian aspect and is inspired by the broader concept of gratuitousness. The emphasis is on the concept of narrative identity and the important dialectic between idem and ipse identities. Narrative identity makes the precarious balance between ipseity and sameness manageable and sustainable; each individual constructs his or her identity at various stages of his or her life through recognition and needs to narrate to himself or herself and others the path of his or her existence; in this context, the normativity of recognition, together with the legal dimension allow him or her to crystallize the milestones of his or her existential journey. Subject of study is the concept of society and the role of institutions, focusing on the concept of justice, good life and moral norm. Themes, these, fundamental to introducing the broader and more complex concept of the subject of law closely linked to the theme of imputability and responsibility. The French philosopher's attention to the subject of justice is closely linked to ethics and morality; there emerges the juridical openness toward which the French philosopher moves so that the institution is included among the inter-personal forms of otherness. The itinerary traced by Ricoeur accompanies his reader to move away from a narcissistic and identitarian view of the self as a self-referential subject characterized by a closed structure and a consideration of the social bond useful only for selfish purposes, but rather to have a solidaristic view having an open structure of the self
La presente ricerca dal titolo: Società, Alterità e Diritto. Il «socius» e il prossimo in Paul Ricoeur e in prospettiva filosofico-giuridica ha come riferimento il pensiero di Paul Ricoeur, uno dei maggiori filosofi e pensatori francesi del Novecento, il quale ci ha donato un’imponente produzione destinata a lasciare una traccia indelebile nella letteratura filosofica contemporanea; l'alto valore della sua opera, originale e variegata, è frutto di un percorso filosofico che dalla fenomenologia e dall'esistenzialismo si orienta verso l'ermeneutica e la psicanalisi. Snodo centrale del presente lavoro è il soggetto e la sua costitutiva e imprescindibile relazione con l’Altro nelle sue molteplici forme; altro da intendere come estraneo, come prossimo, come ciascuno, come sé stesso. Fondamentale risulta l’opera Soi même comme un autre espressione del nucleo teoretico ricoeuriano poiché condensa il senso più profondo della concezione di soggettività proposta da Ricoeur: la valenza, non comparativa, ma esplicativa del «come» se stesso «in quanto» altro costituisce un modo di pensare l’identità e il soggetto, non più in termini di autoposizione soggettiva di stampo cartesiano e moderno, ma secondo una prospettiva fenomenologico-ermeneutica per la quale l’altro risulta implicato a un livello originario e profondo nel processo di costituzione del sé. Alla luce di tali considerazioni l’ermeneutica del sé rappresenta l’unica via percorribile per la filosofia riflessiva in quanto elabora un concetto di identità derivante da un lungo iter ermeneutico tracciato nel mondo dei segni dell’altro. L’obiettivo è quello di offrire al lettore, mediante lo studio delle principali categorie di alterità, una prospettiva nuova della visione stessa di società intesa come Società di diritti caratterizzata da una logica - definita dall’autore - della reciprocità o della sourabondance che va oltre l’aspetto utilitaristico e si ispira al più ampio concetto di gratuità. L’accento verte sul concetto di identità narrativa e sull’importante dialettica tra identità idem e ipse. L’identità narrativa rende gestibile e sostenibile l’equilibrio precario tra ipseità e medesimezza; ciascun individuo costruisce la propria identità nelle varie fasi della propria vita mediante il riconoscimento e necessita di narrare a sé stesso e agli altri il percorso della propria esistenza; in tale contesto, la normatività del riconoscimento, insieme alla dimensione giuridica gli consentono di cristallizzare le tappe fondamentali del proprio percorso esistenziale. Oggetto di approfondimento il concetto di società e il ruolo delle istituzioni, ponendo l’attenzione sul concetto di giustizia, di vita buona e di norma morale. Temi, questi, fondamentali per introdurre il più ampio e complesso concetto di soggetto di diritto strettamente legato al tema della imputabilità e della responsabilità. L’attenzione del filosofo francese verso il tema della giustizia è strettamente legata all’etica ed alla morale; emerge l’apertura giuridica verso la quale il filosofo francese si muove affinché l’istituzione venga inserita tra le forme inter-personali dell’alterità. L’itinerario tracciato da Ricoeur accompagna il suo lettore ad uscire da una visione narcisistica e identitaria dell’io come soggetto autoreferenziale caratterizzato da una struttura chiusa e da una considerazione del legame sociale utile solo a fini egoistici, bensì ad avere una visione solidaristica avente una struttura aperta dell’io
