The principle of continuity can legitimately be considered as a general principle of the administrative system, finding implementation in the organisation and activity of public bodies. The research work investigates the principle of continuity starting from the philosophical debate which, since ancient times, has concerned the relationship between mutability and stability. Indeed, continuity must be interpreted as an endemic need for the individual and his/her history. After an introductory part on the definition of continuum in history, science and philosophical speculation, the essay goes on with the analysis of the principle in the legal sphere. Continuity is a precondition for the exercise of public authority and is expressed through some legal arrangements which stand as a safeguard for the entire democratic framework of the State. The thesis proposes also some brief reflections on the applications of the principle of continuity in the field of the functioning of Constitutional Institutions as well as with reference to the administrative organization. It is essential to analyse the prorogatio, an institution that entails not a few interpretative doubts as to the nature of the acts performed by expired bodies and as to its configurability as a general principle of the legal system. In relation to the theory of organisation, there are many institutes through which continuity finds expression, from prorogatio to substitution, from putting the public body under the administration of an external commissioner to substitutive power. However, the principle at issue also concerns administrative activity as a whole: the public authority, in light of the general obligation to conclude the procedure with a final deed, laid down by the legislator, may not interrupt the administrative procedure or exempt itself from safeguarding the legitimate interest of the private citizen.
Il principio di continuità può legittimamente configurarsi quale principio generale dell’ordinamento amministrativo, trovando applicazione nell’organizzazione e nell’attività degli enti pubblici. L’elaborato di tesi prende le mosse dal dibattito filosofico che, sin dall’antichità, ha riguardato il rapporto tra mutevolezza e stabilità. Difatti, la continuità non può che configurarsi quale esigenza endemica dell’individuo e della sua storia. Dopo un’introduzione sulla nozione di continuum nella storia, nella scienza, nella speculazione filosofica, si procede con l’analisi del principio in ambito giuridico. La continuità si configura quale precondizione dell’esercizio del potere pubblico e si esplica attraverso taluni istituti che si pongono a presidio dell’intera impalcatura democratica dello Stato. In relazione alla teoria dell’organizzazione, plurimi sono gli istituti attraverso cui la continuità trova espressione, dalla prorogatio alla supplenza, dal commissariamento al potere sostitutivo. Tuttavia, il principio in esame involge anche l’attività amministrativa nel suo complesso: il soggetto pubblico, alla luce del generale obbligo di provvedere fissato dal Legislatore, non può interrompere il procedimento né tantomeno esimersi dal salvaguardare l’interesse legittimo del privato.
