Perché i giuristi nel tempo della povertà? La scienza giuridica odierna e il diritto nelle Humanities

This paper reinterprets, in a contemporary light, Hölderlin’s question about poets in times of poverty, applying it to the figure of the jurist. It explores how legal science, in the postmodern and digital context, must rediscover its critical and philosophical function, moving beyond mere technicality. In an increasingly fragmented and post-metaphysical legal world, the jurist is called upon to exercise an embodied, responsible form of knowledge, capable of drawing on the legacy of the humanities to counter the algorithmic, bureaucratic and impoverished drift of contemporary legality.

Il contributo rilancia, in chiave contemporanea, la domanda di Hölderlin sui poeti nel tempo della povertà, riferendola alla figura del giurista. Il contributo esplora come la scienza giuridica, nel contesto surmoderno e digitale, debba ritrovare la propria funzione critica e filosofica, al di là della pura tecnicalità. In un mondo giuridico sempre più frammentato e post-metafisico, il giurista è chiamato a esercitare un sapere incarnato, responsabile, capace di raccogliere l’eredità delle Humanities per contrastare la deriva algoritmica, burocratica e impoverita della giuridicità contemporanea.
