This research thesis investigates the regulation of public prosecutors’ powers to amend charges and, in particular, the concept of “modification of the indictment”, in Italian “fatto diverso”. More specifically, such a work has been structured so as to reflect the indictment preparation phases during criminal proceedings. To begin with, the first section is dedicated to the reconstruction of indictments' historical evolution and references both the 1930 Italian Code of Criminal Procedure and the 1988 Code provisions. Subsequently, the subject has been amended by the Cartabia reform, with particular regard to the preliminary hearing phase. In doing so, such a paragraph undertakes a comprehensive reconstruction of academic debates on previous regulations and the current legislation. The second section focuses on the regulation of public prosecutors’ powers to amend charges, in Italian “nuove contestazioni”, namely Articles 516–522 of the Italian Code of Criminal Procedure. Such a section addresses the core themes of this research work and is of critical significance, as it delves into the Italian juridical concept of “fatto”, which includes both the real-life event and its related legal meaning. The other pillar thoroughly analysed is the “fatto diverso”, meaning that after the real-life event has been ascertained to have materially changed and, as a consequence, there has been a modification of the indictment, under the provisions of Article 516 of the Italian Code of Criminal Procedure. Indeed, provided that the Italian Code of Criminal Procedure does not offer any explicit definition of such concepts, many interpretations have been given. For this reason, this part represents the main body of the research thesis, approached both from an academic perspective, through the accurate analysis of the “modification of the indictment” for particularly challenging types of offences. These include negligent offences as well as the “continuing offences”, meaning the harm persists over time and depends on the ongoing actions of the offender. The notions of “fatto” and “fatto diverso” have been addressed by reconstructing the main positions that have emerged in academic debates. As a result, this study examines the meaning of these concepts in current case law and proposes a new interpretative approach. The concepts of modification of the indictment, fatto diverso, has been analysed in relation to negligent offences and some types of continuing offences, in particular the criminal organisation association crime under Articles 416 and 416-bis of the Criminal Code. Scholarly opinions and prevailing trends in current law have also been examined.
