The traditional category of the reservation of administrative procedure, which has been the subject of study by several generations of scholars, is increasingly frequently invoked by the Constitutional Court within the scope of its review of the admissibility of so-called legislative acts in the form of administrative measures. In this perspective, the former tends to take shape as a sort of centrifugal force in response to the widespread recourse to the latter. An analysis of relevant case law reveals the axiological foundation of this category, identified, in particular, in the principle of due administrative process and in the effectiveness of judicial protection. The reservation of administrative procedure thus operates as a fundamental junction between the procedural and the judicial dimensions of legal protection. On this basis, the study focuses on reconstructing the substantive content of the category, which is articulated into two constitutive dimensions that are logically distinct yet functionally integrated: one relating to the structure of the administrative procedure, the other concerning its quality, enriched by the interaction with private parties. From theoretical elaboration, the analysis moves to the application level, where the reservation of administrative procedure is examined in two sector-specific contexts characterised by multiple layers of complexity, in order to assess, from different perspectives, its operational potential and limits: anti-mafia interdiction information measures, expressing a broadly discretionary administrative power, and demolition orders concerning unlawful constructions, in which administrative action is bound by prior legislative determination. In conclusion, the research highlights a traditional category that reaches the very core of administrative law, testing its resilience in light of the complexities of contemporary reality.

Abstract
In conclusion, the research highlights a traditional category that reaches the very core of administrative law, testing its resilience in light of the complexities of contemporary reality.| File | Dimensione | Formato | |
