This paper analyzes the evolution of the obligation to provide reasons (motivation) for general administrative acts, focusing on the recent ruling no. 415 of November 3rd, 2025, by the T.A.R. Pescara. Although Art. 3, par. 2, of Law no. 241/1990 explicitly excludes acts of a general and regulatory nature from the requirement to provide reasons, the analysis highlights how this exemption is the subject of ongoing doctrinal and jurisprudential debate. By examining the specific case — involving restrictions on the construction of funeral homes imposed by a municipal regulation in Abruzzo — the relationship between national legislation and regional laws is explored, as the latter may impose “reinforced motivation” for reasons of transparency and citizen protection. Furthermore, the paper delves into the nature of motivation as a tool of substantive legality and a potential “essential level of performance” (LEP).
Il presente elaborato esamina l’evoluzione dell’obbligo di motivazione degli atti amministrativi generali, focalizzandosi sulla recente sentenza n. 415 del 03.11.2025 del T.A.R. Pescara. Sebbene l’art. 3, comma 2, della legge n. 241/1990 escluda espressamente gli atti a contenuto generale e normativo dall’obbligo di motivazione, l’analisi evidenzia come tale deroga sia oggetto di un costante dibattito dottrinale e giurisprudenziale. Attraverso l’esame del caso specifico — riguardante le limitazioni all’edificabilità di case funerarie imposte da un regolamento comunale in Abruzzo — viene esplorato il rapporto tra la normativa statale e le leggi regionali, le quali possono imporre una “motivazione rafforzata” per ragioni di trasparenza e tutela del cittadino. Il contributo, inoltre, approfondisce la natura della motivazione come strumento di legalità sostanziale e possibile “livello essenziale delle prestazioni” (LEP).
