Spinte gentili per la pubblica amministrazione?

The article analyses an interesting book about the concept of nudge and public admin istration, developing two level of observation: the one about the use of behavioural eco nomics and of the nudge in the fight against the pandemic and the other one, more pro spectively, about the innovative public policies inspired by the dictates of cognitive sci ences and behavioural law. The final part of the work is dedicated to highlighting the lights and shadows of these two perspectives. While from one hand, it is certainly import ant for the positive jurist to become aware of the many ideas that come from the debate on neoliberal governance techniques, also with reference to the characteristics of public power, on the other, many other questions remain open, such as the one around the stra tegic uselessness in terms of effectiveness, but at the same time of the legal need to have a transparent and participatory nudge.

Nell’articolo si analizza un interessante libro su nudge e pubblica amministrazione, svi luppando due punti di osservazione: quello dell’uso dell’economia comportamentale e del nudge nella lotta alla pandemia e quello, più prospettico, di talune innovative politiche pubbliche ispirate ai dettami delle scienze cognitive e del behavioural law. La parte final del lavoro è dedicata ad evidenziare luci e ombre di tali prospettive. Se da un lato è sicura mente importante che il giurista positivo prenda consapevolezza dei tanti spunti che ven gono dal dibattito sulle tecniche di governo neoliberali, anche con riferimento ai caratte ri del pubblico potere, dall’altro restano aperte tante questioni, come quella della dubbia utilità strategica di un nudge trasparente e partecipato, che pure sembrerebbe giuridica mente più coerente con la sensibilità contemporanea.
