Reading the book Law and Recognition. Juridicality as human capacity, it emerges how law is not only understood as a system of norms, procedures and apparatuses consolidated over time, but as a social praxis of mutual recognition, an experience that nourishes the human capacity to weigh and measure the surplus of vitality proper to each living being in the presence of the otherness with which each one enters into relationship. At the basis of law understood as recognition there is first and foremost an understanding of oneself that makes the encounter with the other possible, and the human making of experience acquires its features. The work focuses on the concept of otherness and law as understood between hermeneutics and practical reason, on law in human existence and the ethics of recognition and care, and on the legal prerequisites of democratic openness: reciprocity and communicative freedom in the unceasing dialectic between law and justice.
Dalla lettura del volume Diritto e Riconoscimento. La giuridicità come capacità umana emerge come il diritto non sia inteso solo come un sistema di norme, di procedure e apparati consolidati nel tempo ma come una prassi sociale di reciproco riconoscimento, un’esperienza che alimenta la capacità umana di ponderare e misurare l’eccedenza di vitalità propria di ciascun vivente al cospetto dell’alterità con cui ciascuno entra in relazione. Alla base del diritto inteso come riconoscimento vi è innanzitutto la comprensione di sé stessi che rende possibile l’incontro con l’altro e il farsi umano dell’esperienza acquisisce le sue fattezze. Il lavoro si incentra sul concetto di alterità e di diritto inteso tra ermeneutica e ragion pratica, sul diritto nell’esistenza umana e sull’etica del riconoscimento e della cura e sui presupposti giuridici dell’apertura democratica: reciprocità e libertà comunicativa nell’incessante dialettica tra diritto e giustizia.
