Este escrito recorre, valiéndose de un enfoque comparativo, la génesis y evolución de la problemática de la fiscalización del acto político. A través de este análisis, que es al mismo tiempo histórico-evolutivo y comparado, se subraya la imposibilidad de configurar una noción única e inmutable de acto político y se distingue esta temática como criterio metodológico privilegiado para medir la evolución de la «política» jurisprudencial en los diferentes ordenamientos considerados. A su vez, esta última suele mostrarse dependiente del orden institucional de un país y de las relaciones cambiantes entre poderes, funciones y fuentes, a pesar de la tendencia común a una importancia cada vez más marcada de los principios de efectividad y de plenitud de la tutela judicial.

Abstract
The paper traces, using a comparative approach, genesis and evolution about the possibility of judging the political act. Through this analysis, which is both historical-evolutionary and comparative, we underline the impossibility of creating a single and unchanging notion of political act, and we identify this issue as a methodological criterion of choice for measuring the evolution of the judicial “politics” in the various systems already considered.
