Abstract

e paper understands mediation in the Mediterranean as interculture. It distinguishes two levels – the dialogue among the systems of rights in force in the region and the core of human rights of universal scope – and argues that each depends on the other. Drawing on François Jullien’s notion of de-coincidence, culture is read as identity in motion and mediation as a practice that inhabits the distance between the parties rather than deciding between them. e case of the repudiated woman required to self-certify her marital status, settled by adding the option ‘separated’ to public administration forms, shows an intercultural translation that translates the fact first and identifies the rule on that basis. e outcome is a law built from the fact and oriented not towards an abstract universal but towards an ‘intimate universal’.
