The question of effectiveness is at the core of social rights’ issue in many contemporary legal systems. Against this backdrop, the paper focuses on the potential of the European Social Charter at national level, particularly in the Italian context. Extending to the Charter the same pattern adopted for the European Convention on Human Rights by the most recent Constitutional Court’s case-law, it is argued, could gain new opportunities for social rights and improve the current multilevel protection system.

Abstract
