La responsabilità del legislatore e la caduta dei miti

The essay focuses on law-makers liability, the last myth of the supremacy of representative political bodies in the post-war Constitutions arisen in Europe. After a brief theoretical inquiry, the writing dwells upon compared and EU factors that push for an overtaking of that myth and upon the legal means for asserting law-maker liability in Italian system.

Il saggio affronta il tema della responsabilità del legislatore, quale ultimo mito dell'infallibilità del potere sovrano, sopravvissuto all'avvento delle Costituzioni europee del secondo dopoguerra. Dopo una breve indagine teorica, lo scritto si sofferma sugli elementi, tratti anche dall'esperienza comparata ed europea, che portano verso il superamento di quel mito e sugli strumenti giuridici in grado di far valere la responsabilità del legislatore nel nostro ordinamento.
