Decisions concerning the health of minors, including those relating to vaccinations, are made jointly by the parents or, failing that, by the guardian. The article analyzes the case of failure of the agreement between the parents or between them and the minor in the choice of giving the vaccine to minors, especially with regards to anti Covid vaccine. The issue, analyzed by jurisprudence, was resolved with the temporary suspension of the parental responsibility of the parent opposed to vaccination to allow the other to give consent to thetherapeutic treatment on their child. Proceeding from the case decided by the Court of Monza on 22 July 2021, it was possible to make more general considerations on the role of anti Covid vaccination as an act of social solidarity, on the enhancement of the consent of the minor who agrees to vaccinate, and on the implementation of the precautionary principle, recalled by the Italian administrative jurisprudence to support that vaccination is suggested precisely by the probability of contracting very contagious diseases.
Le decisioni che attengono alla salute dei minori, inclusa quella relativa alle vaccinazioni, sono prese congiuntamente dai genitori o, in mancanza, dal tutore. L’articolo analizza le ipotesi in cui sulla scelta di somministrare il vaccino ai minori e, in particolare, il vaccino anticovid, manchi l’accordo tra i genitori o tra essi ed il minore. La questione, analizzata dalla giurisprudenza, è stata risolta con la sospensione temporanea della responsabilità genitoriale del genitore contrario alla vaccinazione per consentire all’altro di dare il consenso al trattamento terapeutico sul proprio figlio. Procedendo dal caso deciso dal Tribunale di Monza il 22 luglio 2021 è stato possibile effettuare delle considerazioni più generali sul ruolo della vaccinazione anticovid come atto di solidarietà sociale, sulla valorizzazione del consenso del minore che accetta di vaccinarsi, e sull’attuazione del principio di precauzione, richiamato dalla giurisprudenza amministrativa italiana per suffragare che la vaccinazione sia suggerita proprio dalla probabilità di contrarre malattie molto contagiose.
